Terms & Conditions

1. General Terms 

These T&Cs, along with any non-excludable implied terms by law, constitute the entire agreement between the applicant named in the quotation and/or purchase order (referred to as "Customer" or "you/your") and Tasman Saunas Limited (referred to as "we/us/our"). 

By placing an order or making a deposit for the supply of goods and/or services as advertised on this website or elsewhere, you are deemed to have accepted these T&Cs. These T&Cs supersede all other written agreements with us. 

2. Quotations, Pricing & Deposits 

Prices charged will be based on the current quotation or determined by us using our standard prices at the order date. We reserve the right to increase prices, but the prices for existing orders accepted by us will not change. A quotation is valid for 5 days from the date of issuance. We are not responsible for errors in specifications, details, sizes, and quantities provided by you.

All saunas, hot tubs and ice baths require a non-refundable deposit. We do not provide refunds in the event of change of mind purchase or order cancellation. In the event of order cancellation, the deposit will be retained by Tasman Saunas Limited to cover incurred costs, including shipping, handling, storage, and resale expenses.

In instances such as home shows, events and special offers where Tasman Saunas Limited accept a deposit, this will be non-refundable  in the event of change of mind purchase or order cancellation.  

Electronic signatures on documents are binding from the time a person affixes a signature on your behalf.  Quoted prices do not include (unless specified) any statutory taxes, duties, or imposts levied in respect of the goods.

Any order that cannot be fulfilled upon receipt will automatically be back-ordered  and processed when stock becomes available. Deliveries at any time are subject to the availability of stock, and we will not be liable for any charges due to product unavailability.

Note, all products require assembly. Assembly is not included in the price listed on the website and this is not a service offered by Tasman Saunas. Tasman Saunas may provide you with the names of third parties who you may contact to arrange installation, however in no event will Tasman Saunas be responsible or liable for any work undertaken by third parties who manage assembly of the products. 

Tasman Saunas will never undertake electrical work or include this in any quote. All electrical work must be carried  out by a registered electrician as defined by your state or region.

Price Match Terms and Conditions:

Tasman Saunas reserves the right to refuse a Price Match  request if the eligibility criteria are not met. Price matching is applicable to the product price only and does not include shipping, taxes, or other fees. The Price Match Policy applies to new, identical, and in-stock items only.

Price matching cannot be combined with other promotions, discounts, or offers. Tasman Saunas may adjust the price on the product or offer a discount code to match the lower price. Tasman Saunas has the right to modify or terminate the Price Match Policy at any time without notice.

Price Match does not apply to products listed on auction sites or wholesale sites such as Alibaba, eBay and Third Party retailers.

3. Payment Options

A deposit is required at the time of purchase. The balance of the order must be paid before we arrange the dispatch of the goods. We may exercise our discretion to determine the circumstances in which a deposit may be refundable, however refunds are not offered in the event of shipping delays.

Full payment for the items listed in purchase order  must be received prior to Tasman Saunas Limited booking delivery or pickup at a depot. Ownership of the goods remains with Tasman Saunas Limited until full payment is received.

Payment by credit card (Mastercard & Visa) is subject to a 2% credit charge surcharge. Failure to make the balance payment for ordered goods may result in the following actions:

Suspension or discontinuation of goods supply and/or cancellation of your account with us. 

Charging the Customer a weekly storage fee if Tasman Saunas Limited needs to hold your stock for longer than 3 days past the initial dispatch date, unless otherwise specified in writing. The storage fee will be determined at the time based on market rates taking into account the costs to be recovered.

We reserve the right to set-off any amounts owed to us by you against any money owed to you on any account. 

You are responsible for all reasonable expenses (including debt collection commission) and legal costs (on a full indemnity basis) incurred by us for enforcing obligations and recovering money due from you.

Any outstanding amounts become immediately due and payable if you default in paying any sums due to us, become bankrupt, commit any act of bankruptcy, or have a judgment entered against you in any court, regardless of any other clause in these T&Cs.

4. Restrictions

You acknowledge and accept that we sell our goods only through persons who have been authorised by us to sell specific product  categories at specific locations and who comply with our Terms and Conditions

Freight: otherwise agreed, we will ship by the least expensive route and carrier to all points. If you choose a route with a higher charge than the route of our choice for shipment, we will charge the difference to you.

Force Majeure: we shall be released from our obligations in the event of a national, war, pandemic, prohibitive governmental regulation, or any other cause beyond the control of the parties that renders the provision of the goods impossible. In such cases, all money due to us shall be paid immediately, and, unless prohibited by law, we may elect to terminate the agreement.

5. Variation

We may vary these terms by providing written notice to you (by email, conventional mail, or by posting the amended terms on our website).

If you do not deem the variation acceptable and you are a consumer, you may elect not to proceed with the purchase of the goods ordered before the date of the variation.

Failure to Act: Our failure to enforce or insist upon the timely performance of any term, condition, covenant, or provision in these terms, or our failure to exercise any right or remedy available under these terms or at law, or our failure to insist upon timely payment of monies when due or to demand payment of any charges or fees (e.g., storage fees) that accrue or any extension of creditor forbearance under these terms shall not constitute a waiver of any subsequent default or a waiver of our right to demand timely payment of future obligations or strict compliance with the terms.

6. Legal Construction

Where you are based in New Zealand these terms shall be governed by and interpreted according to the laws of New Zealand and the parties consent and submit to the jurisdiction of Courts of New Zealand. 

Where you are based in Australia these terms shall be governed by and interpreted according to the laws of Australia and the parties consent and submit to the jurisdiction of Courts of Australia.

Notwithstanding that any provision of the terms may prove to be illegal or unenforceable pursuant to any statute or rule of law or for any other reason, that provision is deemed omitted without affecting the legality of the remaining provisions, and the remaining provisions of the terms shall continue in full force and effect.

7. Differences

Final product may vary to from what is listed on the website due to product updates by the manufacturer. We will endeavour to advise you of any material changes. Some examples of variations include dimensions, weather-proofing, logo additions to name a few.  

All of the information provided on our website comes from the most up to date specifications supplied to us by our manufacturers. By purchasing from us you acknowledge that the product specifications may differ slightly to what is provided on our website.

Please note, all outdoor saunas come with free asphalt roofing material for weather proofing and this is not depicted on our website. Further, all sauna products require staining by the user.

8. Warranty 

Tasman Saunas Limited warrants the outdoor saunas wood material for five years from the date of delivery against failure due to faulty workmanship or materials, subject to the limitations, conditions, and exclusions expressed in this warranty.

All other outdoor sauna components and parts, including but not limited to the heater and accessories, are warranted for two years from the date of delivery against failure due to faulty workmanship or materials, subject to the limitations, conditions, and exclusions expressed in this warranty.

Outdoor Saunas & Hot Tubs:

Red Cedar wood material warranty: 5 years from the delivery date against failure due to faulty workmanship or materials. This warranty covers the structural integrity of the sauna's wood components, ensuring a durable and reliable outdoor sauna experience.

Other components and parts warranty: 2 years from the delivery date against failure due to faulty workmanship or materials. This includes the warranty for various sauna components and parts, such as electrical elements, controls, and accessories, to provide peace of mind during the initial years of usage.

Important: Pine wood material warranty is limited to 12 months post purchase.  This warranty covers the structural integrity of the sauna's wood components, ensuring a durable and reliable outdoor sauna experience.

Warranty Limitations and Exclusions for Outdoor Saunas & Hot Tubs:

After 6 months, this warranty is limited to the supply of replacement parts and excludes labour. Regular maintenance and prompt replacement of faulty parts are necessary for continued sauna performance.

Improper installation caused by assembly, as well as installation in an electrical circuit not protected by an appropriately rated RCD and installed to national electrical standards, is excluded from this warranty. Proper installation is vital to ensure the safe and effective operation of the sauna.

Improper assembly of any of our products, especially Outdoor Saunas & Hot Tubs can result in loss of weather tightness which can cause water to leak and temperature variations from what the product has been tested for. This is not covered by your warranty.

Subsequent transport of the constructed sauna may cause damage to the product and electrical components, and any faults caused in this way are excluded from this warranty. It is essential to handle the sauna with care during transport to avoid damage.

Warping or damage caused by failure to cover the product when packaged in protective wrap and excessive exposure to sunlight is excluded from this warranty. Proper packaging and protection during storage and transit are essential to preserve the sauna's quality.

Water damage, stains, or swelling of the wood due to sweat or spillage are not covered under this warranty. Proper maintenance and care, including wiping away moisture and spills, are essential to protect the wood.

Hot Tubs need to have filters replaced after every 3-6 months. Failure to do this will result in faults in your Hot Tub and will void your warranty.

Warranties for Indoor Saunas & Ice Baths: 

Cabinetry warranty: 3 years. This warranty covers the cabinetry's structural integrity, ensuring a durable and long-lasting indoor sauna experience.

Heater warranty: 2 years. This extended warranty provides added protection for the sauna's heating element, one of the critical components in providing a comfortable and enjoyable sauna experience.

Componentry warranty: 2 years. This warranty covers various sauna components and parts, offering reliable usage during the initial years of ownership.

Warranty Limitations and Exclusions for Indoor Saunas & Ice Baths:

Improper installation, and subsequent transport damage are excluded from this warranty for indoor saunas and ice baths.

After 6 months, this warranty is limited to the supply of replacement parts and excludes labour and shipping costs. Water damage, stains, or swelling of the wood due to sweat or spillage are not covered under this warranty. Proper maintenance and care, including wiping away moisture and spills, are essential to protect the wood.

Indoor Saunas require clearance of 50cm on all sides for property ventilation. Sauna heaters must be placed 100mm off the ground. Sauna rocks must be inspected on a monthly basis to minimise the risk of damage.

Ice baths need to have filters replaced after every 10-15 sessions. Failure to do this will result in faults in your chiller and will void your warranty.

Accessories Warranty:

Handrails, towel rails, steps, covers, and shower warranty: 1 year. This warranty ensures that these accessories are free from defects in workmanship and materials during the initial year of use.

Seconds & Clearance Warranty

The product is sold in as-is condition as a second and is not in new condition. The warranty is limited to: Structural Warranty: 6 months from the date of purchase. Component Warranty: 2 months from the date of purchase.

This limited warranty covers defects in materials and workmanship under normal use and maintenance. It does not cover known faults, damage resulting from misuse, accidents, neglect, or unauthorized modifications. This warranty is limited to the supply of replacement parts and excludes labour and shipping costs

Commercial Use:

Our products are designed for personal use only. Using our products for commercial use disqualifies you from making a warranty claim under our personal warranty terms.

Additionally, all other components and parts of the outdoor sauna, comprising the heater and accessories, are also covered by a six-month warranty from the delivery date against failures attributable to faulty craftsmanship or materials. However, this coverage does not extend to warping or damage resulting from inadequate packaging protection during transport or prolonged exposure to sunlight. Moreover, any damage arising from improper installation, including installation within an electrical circuit lacking proper RCD protection and adherence to national electrical standards, is not covered under this warranty.

It is important to note that some degree of warping and cracking is inherent due to the natural properties of wood, and thus, is not considered a defect in the product itself. Consequently, such occurrences are not eligible for coverage under this warranty.

Any damages incurred during subsequent transportation of the assembled sauna , resulting in harm to the product or electrical components, are also excluded from this warranty. Furthermore, water-related damages, stains, or wood swelling due to sweat or spillage are not covered. Labor and delivery costs associated with any repairs or replacements during the coverage period are not included in this warranty. 

Warranty Summary:

Tasman Saunas Limited aims to provide high-quality saunas for your enjoyment. However, please follow the warranty limitations, proper maintenance, and installation guidelines to ensure optimal performance and longevity of your sauna. In case of any defects, contact Tasman Saunas Limited or its representative promptly to initiate the warranty process. Please note, this warranty does not cover transit damage.  

Any claim for transit damage must be made withing 24 hours of delivery and must be supported by photos. From there, we will negotiate any claim for compensation with the delivery provider on behalf of the customer.

Australian Consumer Guarantees:

Your rights under the Australian Consumer Law are in addition to this warranty. The Australian Consumer Law provides certain guarantees and protections for consumers in relation to goods and services.

New Zealand Consumer Guarantees:

We will comply with our obligation in the Consumer Guarantees Act. The act provides certain guarantees and protections for consumers in relation to goods and services.
